Bu Kullanım Koşulları ("Koşullar"), Ads&Events web sitesi (adsandevents.com) ve mobil uygulamasının ("Hizmet") kullanımını düzenlemektedir. Hizmeti kullanarak bu Koşulları kabul etmiş sayılırsınız.
1. Hizmetin Tanımı
Ads&Events, etkinlik yönetimi için kapsamlı bir SaaS (Software as a Service) platformudur. Hizmetlerimiz şunları içerir:
- Etkinlik oluşturma ve yönetimi
- Katılımcı kaydı ve takibi
- QR kod ve NFC tabanlı check-in sistemi
- E-posta otomasyonu ve bildirimler
- Anket ve geri bildirim toplama
- Raporlama ve analitik
- Mobil uygulama (iOS ve Android)
2. Hesap Oluşturma ve Güvenlik
2.1 Kayıt
- Hizmeti kullanmak için geçerli bilgilerle kayıt olmanız gerekmektedir.
- 18 yaşından büyük olmanız gerekmektedir.
- Tüzel kişiler adına kayıt yapan kişiler, yetkili temsilci olmalıdır.
2.2 Hesap Güvenliği
- Hesap bilgilerinizi gizli tutmaktan sorumlusunuz.
- Hesabınızdaki tüm aktivitelerden sorumlusunuz.
- Yetkisiz erişimi derhal bildirmeniz gerekmektedir.
3. Mobil Uygulama Kullanımı
3.1 Lisans
Size, Ads&Events mobil uygulamasını kişisel cihazınızda kullanmak için sınırlı, münhasır olmayan, devredilemez bir lisans veriyoruz.
3.2 Kısıtlamalar
Aşağıdaki eylemleri gerçekleştiremezsiniz:
- Uygulamayı kopyalamak, değiştirmek veya dağıtmak
- Uygulamayı tersine mühendislik yapmak veya kaynak kodunu çıkarmaya çalışmak
- Uygulamayı yasadışı amaçlarla kullanmak
- Başka kullanıcıların verilerine yetkisiz erişim sağlamaya çalışmak
- Uygulamanın güvenlik önlemlerini aşmaya çalışmak
3.3 Uygulama Mağazası Koşulları
Mobil uygulamamız Apple App Store ve Google Play Store üzerinden dağıtılmaktadır. Bu mağazaların kullanım koşulları da geçerlidir.
4. Kabul Edilebilir Kullanım
4.1 Yapılması Gerekenler
- Hizmeti yasalara uygun şekilde kullanın
- Doğru ve güncel bilgiler sağlayın
- Diğer kullanıcıların haklarına saygı gösterin
- Etkinlik katılımcılarının gizliliğini koruyun
4.2 Yasaklanan Eylemler
- Spam veya istenmeyen iletişim göndermek
- Zararlı yazılım yaymak
- Sahte veya yanıltıcı etkinlikler oluşturmak
- Başkalarının kimlik bilgilerini kullanmak
- Hizmeti kötüye kullanarak sistem kaynaklarını tüketmek
- Diğer kullanıcılara zarar vermek veya taciz etmek
- Yasadışı içerik paylaşmak veya yasadışı faaliyetlerde bulunmak
5. Fikri Mülkiyet
5.1 Şirket Hakları
Ads&Events markası, logosu, yazılımı, tasarımı ve içeriği dahil tüm fikri mülkiyet hakları bize aittir. Bu haklar, uluslararası telif hakkı ve ticari marka yasaları ile korunmaktadır.
5.2 Kullanıcı İçeriği
- Yüklediğiniz içerikler üzerindeki haklarınız size aittir.
- İçeriklerinizi hizmetimizde kullanmak için bize lisans verirsiniz.
- Yüklediğiniz içeriklerin yasal olduğunu garanti edersiniz.
6. Ödeme
6.1 Uygulama İçi Satın Alma
- Etkinlik oluşturma hizmeti, mobil uygulama üzerinden uygulama içi satın alma (In-App Purchase) yoluyla sunulmaktadır.
- Ödemeler Apple App Store veya Google Play Store üzerinden işlenir.
- Fiyatlar uygulama mağazalarında belirtilmektedir.
6.2 İadeler
- İade talepleri ilgili uygulama mağazasının (Apple App Store veya Google Play Store) iade politikalarına tabidir.
- İade talepleri doğrudan ilgili mağaza üzerinden yapılmalıdır.
7. Hizmet Seviyesi ve Erişilebilirlik
7.1 Erişilebilirlik
Hizmetimizi %99.9 erişilebilirlik hedefiyle sunmaya çalışıyoruz. Ancak planlı bakım veya beklenmedik kesintiler olabilir.
7.2 Destek
- E-posta desteği tüm planlar için mevcuttur.
- Öncelikli destek profesyonel ve kurumsal planlarda sunulmaktadır.
- Destek saatleri: Hafta içi 09:00-18:00 (Türkiye saati)
8. Veri ve Gizlilik
Kişisel verilerin işlenmesi Gizlilik Politikamız ve KVKK Aydınlatma Metnimiz çerçevesinde gerçekleştirilir. Bu belgeleri de kabul etmiş sayılırsınız.
9. Sorumluluk Sınırlamaları
9.1 Garanti Reddi
Hizmet "olduğu gibi" sunulmaktadır. Kesintisiz veya hatasız çalışma garantisi verilmemektedir.
9.2 Sorumluluk Sınırı
- Dolaylı, tesadüfi veya sonuç olarak ortaya çıkan zararlardan sorumlu değiliz.
- Toplam sorumluluğumuz, son 12 ayda ödediğiniz tutarla sınırlıdır.
- Üçüncü taraf hizmetlerinin kesintilerinden sorumlu değiliz.
10. Tazminat
Bu Koşulları ihlal etmeniz veya hizmeti kötüye kullanmanız nedeniyle ortaya çıkan tüm talep, dava ve masraflardan bizi tazmin etmeyi kabul edersiniz.
11. Fesih
11.1 Kullanıcı Tarafından Fesih
- Hesabınızı istediğiniz zaman kapatabilirsiniz.
- Abonelik döneminin sonuna kadar hizmet kullanılabilir.
- Verilerinizin silinmesini talep edebilirsiniz.
11.2 Şirket Tarafından Fesih
- Koşulları ihlal etmeniz durumunda hesabınızı askıya alabilir veya sonlandırabiliriz.
- Önemli ihlallerde derhal fesih uygulanabilir.
- Fesih durumunda bilgilendirilirsiniz.
12. Değişiklikler
Bu Koşulları zaman zaman güncelleyebiliriz. Önemli değişiklikler 30 gün öncesinden bildirilir. Değişiklik sonrası hizmeti kullanmaya devam etmeniz, yeni koşulları kabul ettiğiniz anlamına gelir.
13. Uygulanacak Hukuk ve Uyuşmazlık Çözümü
- Bu Koşullar Türkiye Cumhuriyeti hukukuna tabidir.
- Uyuşmazlıklar İstanbul Mahkemeleri ve İcra Dairelerinde çözülür.
- Tüketici hakları saklıdır.
14. Genel Hükümler
- Bölünebilirlik: Herhangi bir hükmün geçersiz bulunması diğer hükümleri etkilemez.
- Feragat: Bir hakkın kullanılmaması, o haktan feragat anlamına gelmez.
- Devir: Bu sözleşme izinsiz devredilemez.
- Bütünlük: Bu Koşullar, Gizlilik Politikası ve KVKK Aydınlatma Metni ile birlikte tam sözleşmeyi oluşturur.

These Terms of Service ("Terms") govern the use of the Ads&Events website (adsandevents.com) and mobile application ("Service"). By using the Service, you agree to these Terms.

Ads&Events is a comprehensive SaaS (Software as a Service) platform for event management. Our services include:
- Event creation and management
- Participant registration and tracking
- QR code and NFC-based check-in system
- Email automation and notifications
- Survey and feedback collection
- Reporting and analytics
- Mobile application (iOS and Android)
2. Account Creation and Security
2.1 Registration
- You must register with valid information to use the Service.
- You must be over 18 years old.
- Individuals registering on behalf of legal entities must be authorized representatives.
2.2 Account Security
- You are responsible for keeping your account information confidential.
- You are responsible for all activities in your account.
- You must immediately report unauthorized access.
3. Mobile Application Usage
3.1 License
We grant you a limited, non-exclusive, non-transferable license to use the Ads&Events mobile application on your personal device.
3.2 Restrictions
You may not:
- Copy, modify, or distribute the application
- Reverse engineer or attempt to extract source code
- Use the application for illegal purposes
- Attempt to gain unauthorized access to other users' data
- Attempt to bypass security measures
3.3 App Store Terms
Our mobile application is distributed through Apple App Store and Google Play Store. The terms of use of these stores also apply.
4. Acceptable Use
4.1 Required Conduct
- Use the Service in compliance with laws
- Provide accurate and up-to-date information
- Respect the rights of other users
- Protect the privacy of event participants
4.2 Prohibited Actions
- Sending spam or unwanted communications
- Distributing malware
- Creating fake or misleading events
- Using others' credentials
- Consuming system resources through abuse
- Harming or harassing other users
- Sharing illegal content or engaging in illegal activities
5. Intellectual Property
5.1 Company Rights
All intellectual property rights, including the Ads&Events brand, logo, software, design, and content, belong to us. These rights are protected by international copyright and trademark laws.
5.2 User Content
- You retain rights to content you upload.
- You grant us a license to use your content in our service.
- You guarantee that content you upload is legal.
6. Payment
6.1 In-App Purchase
- Event creation service is offered through In-App Purchase via our mobile application.
- Payments are processed through Apple App Store or Google Play Store.
- Prices are displayed in the respective app stores.
6.2 Refunds
- Refund requests are subject to the refund policies of the respective app store (Apple App Store or Google Play Store).
- Refund requests should be made directly through the respective store.
7. Service Level and Availability
7.1 Availability
We strive to provide our service with 99.9% availability. However, scheduled maintenance or unexpected outages may occur.
7.2 Support
- Email support is available for all plans.
- Priority support is offered in professional and enterprise plans.
- Support hours: Weekdays 09:00-18:00 (Turkey time)
8. Data and Privacy
Processing of personal data is carried out within the framework of our Privacy Policy and KVKK Notice. You are deemed to have accepted these documents as well.
9. Limitation of Liability
9.1 Warranty Disclaimer
The Service is provided "as is". No guarantee of uninterrupted or error-free operation is given.
9.2 Liability Limit
- We are not liable for indirect, incidental, or consequential damages.
- Our total liability is limited to the amount you paid in the last 12 months.
- We are not responsible for interruptions to third-party services.
10. Indemnification
You agree to indemnify us for all claims, lawsuits, and expenses arising from your violation of these Terms or misuse of the Service.
11. Termination
11.1 Termination by User
- You can close your account at any time.
- Service can be used until the end of the subscription period.
- You can request deletion of your data.
11.2 Termination by Company
- We may suspend or terminate your account if you violate the Terms.
- Immediate termination may apply for serious violations.
- You will be notified in case of termination.
12. Changes
We may update these Terms from time to time. Significant changes will be notified 30 days in advance. Continuing to use the service after changes means you accept the new terms.
13. Governing Law and Dispute Resolution
- These Terms are subject to the laws of the Republic of Turkey.
- Disputes will be resolved in Istanbul Courts and Enforcement Offices.
- Consumer rights are reserved.
14. General Provisions
- Severability: Invalidity of any provision does not affect other provisions.
- Waiver: Failure to exercise a right does not constitute waiver.
- Assignment: This agreement cannot be transferred without permission.
- Entirety: These Terms, together with the Privacy Policy and KVKK Notice, constitute the complete agreement.
